To find more court cases that talk about a Restatement section on Westlaw, use a tool called KeyCite. When you're looking at the Restatement section, select "Citing References" to see cases that mention it. You can also search by typing kc:rest and then the details of the Restatement section you want. This helps you find extra cases that might not be listed in the Restatement itself. KeyCite shows more cases because it looks at many sources and documents.

Finding Additional Citing References using KeyCite on Westlaw

It is also possible to KeyCite a Restatement Section on Westlaw by selecting Citing References while viewing a Restatement section, as illustrated below:

From here, you would narrow by jurisdiction for a more manageable and meaningful set of results.


KeyCite Shortcut kc: Prefix

It is also possible to shortcut this process when you already know the Restatement section for which you would like to find all citing references. Use the kc: prefix within the Westlaw search box. Here are some sample queries using this shortcut:

  • kc:rest agen s 1
    • Retrieves citing references for Restatement of Agency, § 1 (spelling out the word "agency" also works)
  • kc:rest 2d contr s 3
    • Retrieves citing references for the Restatement (Second), Contracts, § 3 (spelling out the word "contracts" also works)
  • kc:rest 2d prop-lt s 1.1
    • Retrieves citing references for the Restatement (Second), Property, Landlord and Tenant, § 1.1
  • kc:rest 3d trusts s 17
    • Retrieves citing references for the Restatement (Third) of Trusts, § 17
NOTE: It is quite likely that the number of citing cases identified through KeyCite will be larger than the number of citing cases included with a specific Restatement Section. This is because KeyCite will include unreported opinions that cite the section, as well as other published opinions the editors chose not to include. For example, Looking at § 23 on Contribution illustrated above, there are 48 citing cases according to KeyCite, yet the editors of the Restatement only included 30 (both numbers as of July 2021). KeyCite also captures citations in other secondary sources, and appellate and trial documents (depending on your Westlaw subscription).
